DECREE OF MINISTER OF MARINE AFFAIRS AND FISHERIES

CONCERNING
STIPULATION OF JAVA ISLAND AND BALI ISLAND
AS AREAS INFECTED BY KOI HERVES VIRAL DISEASE IN COMMON CARP AND KOI
MINISTER OF MARINE AFFAIRS AND FISHERIES,
Considering :
- a. that with the finding of Koi Herves Viral Disease in Common Carp Dan Koi in Java Island and Bali Island, its is considered necessary to review Decree of the Minister of Marine Affairs and Fisheries No. KEP.28/MEN/2002 concerning Prohibition of Import and Export to and from and Stipulation of Java Island As Epidemic Area for Viral Pest and Disease in Common Carp Dan Koi;
- b. that upon the finding of Koi Herves Viral Disease in as meant in item a, it is considered necessary to stipulate Java Island and Bali Island as areas infected by Koi Herves Viral Disease in Common Carp Dan Koi;
- c. That in the connection with the above mentioned facts it is necessary to lay down a Decree of the Minister;
In view of :
- 1. Law No. 9/1985 concerning Fisheries;
- 2. Law No. 16/1992 concerning Animal, Fish and Plant Quarantine;
- 3. Government Regulation No. 15/1990 concerning Fishery Business as amended the latest by Government Regulation No. 141/2000;
- 4. Government Regulation No. 15/2002 concerning Fish Quarantine;
- 5. Decree of the President of the Republic of Indonesia No. 228/M/2001 on establishment of Gotong Royong Cabinet;
- 6. Decree of the President of the Republic of Indonesia No. 102/2001 on Status, Tasks, Functions, Authority, Organizational Structures And Working System of Ministries, as already amended by Decree of the President of the Republic of Indonesia No. 45/2002;
- 7. Decree of the President of the Republic of Indonesia No. 109/2001 concerning Organization Unit and Tasks of Echelon I in Ministry, as already amended by Decree of the President of the Republic of Indonesia No. 47/2002;
- 8. Decree of the Minister of Marine Affairs and Fisheries No. KEP.01/MEN/2000 concerning Organization and Work System of the Ministry of Marine Affairs and Fisheries as amended by Decree of the Minister of Marine Affairs and Fisheries No. KEP.30/MEN/2001;
- 9. Decree of Minister of Marine Affairs and Fisheries No. 24/MEN/2002 concerning Systematization and Arrangement of Regulations within Ministry of Marine Affairs and Fisheries;
- 10. Decree of the Minister of Marine Affairs and Fisheries No. KEP.26/MEN/2002 concerning Supply, Circulation, Use and Control of Fish Drug;
HAS DECIDED :
To stipulate:
DECREE OF MINISTER OF MARINE AFFAIRS AND FISHERIES ON THE STIPULATION OF JAVA ISLAND AND BALI ISLAND AS AREAS INFECTED BY KOI HERVES VIRAL DISEASE IN COMMON CARP DAN KOI
FIRSTLY :
To stipulate Java Island and Bali Island as areas infected by Koi Herves Viral Disease in Common Carp Dan Koi.
SECOND :
Export of Common Carp Dan Koi from Java and Bali Islands as meant in FIRST Dictum to other areas shall be subjected to quarantine action.
THIRD :
Import of Common Carp Dan Koi from Overseas is allowed provided that:
- a. Originating from countries that are free from Koi Herves Viral Disease;
- b. Remains subjected to quarantine action;
- c. The entry points shall be Airports Soekarno-Hatta Jakarta, Juanda Surabaya, and Ngurah Rai Denpasar.
FOURTH :
For smooth Implementation of this Decree:
- a. The Director General of Cultivated Fishery and the Head of Marine and Fishery Research Board coordinates with agency in charge of marine affairs and fishery of Provincial and Regency/Municipal Levels, and controls and manages the Koi Herves Viral Disease;
- b. Consumption Common Card and Koi that will be transported from Java Island and Bali Island to other areas of Indonesia shall be given special treatment in accordance with method of delivery and supervision as regulated further by the Director General of Cultivated Fishery;
- c. The Head of Center for Fish Quarantine conducts supervision in Airports, Seaports/River Ports and Ferry Ports to:
- 1. The export and import of Common Carp Dan Koi as meant in SECOND and THIRD Dictums;
- 2. As to owner of Common Carp Dan Koi who will send his/her fishes to other areas of Indonesia, if the fishes area detected infected by Koi Herves Viral Disease, then these fishes shall be refused;
- 3. As to owner of Common Carp Dan Koi who imports his/her fishes from abroad into Indonesian territory, if the fishes area detected infected by Koi Herves Viral Disease, then these fishes shall be destroyed.
FIFTH :
In implementing this Decree, the Official as meant in FOURTH dictum is obliged to submit periodic report on monthly basis to the Minister of Marine Affairs and Fisheries.
SIXTH :
Upon enactment of this Decree, the Decree of the Minister of Marine Affairs and Fisheries No. KEP.28/MEN/2002 concerning Prohibition of Import and Export to and from and Stipulation of Java Island As Epidemic Area for Viral Pest and Disease in Common Carp Dan Koi is declared null and void.
SEVENTH :
This decree shall take into effect on the date of stipulation.
